Tickets and gift certificates purchased through this online service are subject to terms and conditions and privacy policy of this website. 

Please be informed that some of our shows utilize live music, which may be loud for some children. We encourage you to consider this factor prior to purchasing tickets and gift certificates to the show.

CONDITIONS OF SALE AND CONTRACTUAL OBLIGATIONS


Parties

The parties to this Agreement are:


  • Hoopla, Inc.650 (Unit J-2) Jesus Extn.,Pandacan Manila

     - AND -

  • You (also referred to as the "Customer")


Purchased Tickets and Gift Certificates*


You hereby agree to purchase and Hoopla, Inc. agrees to sell the ticket(s) and gift certificate(s) detailed in your Order Information.
 

*Gift Certificate Conditions of Use: A gift certificate entitles you to a seat in one Saltimbanco by Cirque du Soleil performance at the Mall of Asia Arena, which runs from August 9 to August 19, 2012. A gift certificate is assigned a password upon purchase.  The bearer of the said gift certificate must provide the password and the e-mail address used on purchase in order to exchange the certificates for actual tickets. The gift certificate may be exchanged for an actual ticket prior to your preferred show date through the following methods: 1) Proceed to the on-site box office, present your certificate and provide password and e-mail address used on purchase, or 2) Call the customer service hotline 3201111, state your password and e-mail address used on purchase. In cases where the certificate was given as a gift to you, please be ready with the above information. Please claim your ticket early as preferred seats in your category for your chosen show date may run out.

 

A gift certificate has an assigned seat category, which cannot be exchanged for a different seat category. It is valid for single use only and cannot be used in conjunction with other discounts and promotional items. A gift certificate is transferable. If you plan to give it to a third party, make sure that you also provide him with the password and the e-mail address used on purchase.

 

Those who are availing of a senior citizen and PWD discount are requested to present a government-issued identification such as but not limited to: driver's license, senior citizen's I.D. and the like, as mandated by Philippine law. Those who fail to present proper identification will be required to pay the difference at the venue's box office. For more information please refer to the guidelines posted in www.hoopla.ph.


Delivery

Tickets and Gift Certificates – These Tickets and Gift Certificates can either be delivered via e-mail or may be picked-up with prior advise through phone. If you choose to receive the Tickets via e-mail, print your e-tickets and present them at the venue of the show. Certain delays and fees are applicable depending on the delivery mode you choose in your Order Information.


Order Confirmation

Once your payment and order are completed,you will receive a confirmation page and/or email indicating your confirmation number. Keep your confirmation number.

If you do not receive a confirmation number or encounter an error, you must contact our Customer Service Department immediately to confirm whether your order has been properly processed. You are solely responsible for any problem that may occur during the purchase of Tickets and Gift Certificates. In such case, Hoopla, Inc. shall not be held liable for any loss (monetary or otherwise) that may result from any problem occurring during the purchase of Tickets and Gift Certificates through this website, including but not limited to the failure of a transaction to be completed or confirmed.

Orders will be processed only after a billing address and other billing information have been verified. Occasionally, we receive incorrect billing or credit card account information for a Ticket or Gift Certificate order that can delay the processing of the order and the delivery of the Tickets or Gift Certificates. In such case, Hoopla, Inc.’s Customer Service Department may attempt to contact you, using the information provided at the time of purchase. If Hoopla, Inc. is unable to reach you after the initial attempt, it shall reserve the right to cancel your order and sell your Tickets or Gift Certificates to another customer.


Obligation to Pay

By accepting the terms of this Agreement, you agree to pay the full cost of the Tickets or Gift Certificates ordered, including any applicable taxes and delivery, convenience and other fees.


Refunds and Exchanges

You must review your Ticket or Gift Certificate selection before you submit and confirm your order. Subject to the provisions below for cancelled and/or postponed shows, there are no exchanges or refunds once a Ticket or Gift Certificate has been purchased.


Cancellation/Exchange Fees and/or Reprint Fees

In the event a customer requested cancellation or exchange is granted by Hoopla, Inc. management, you will be requested to pay a fixed fee per order.


In the event of lost or destroyed tickets or gift certificates that you request to reprint or resend, you will be requested to pay a fixed fee per order.


By accepting the terms of this Agreement, you agree to pay the full cost of the applicable fees, including any applicable taxes.


Cancelled and/or Postponed Shows

When a show is cancelled or postponed, Hoopla, Inc. has the full discretion to either offer you an exchange or a reinvite.  You have the sole responsibility of verifying if a show for which you have purchased tickets or gift certificates through this website is cancelled or postponed. Please make sure to provide your order confirmation number at the time of your inquiry to facilitate processing of your reinvite or exchange, as applicable.


Late Comers

The show starts on time and latecomers are admitted only during a suitable break in the performance. Late-coming wheelchair-users can only be admitted at the intermission.


Right to Cancel Tickets and Gift Certificates, Refuse Access and Expel

Hoopla, Inc. reserves the right to cancel any Tickets and Gift Certificates, or order of Tickets and Gift Certificates through this website and to institute legal proceedings against you if you breach any terms and conditions of this Agreement on this website.

Hoopla, Inc. reserves the right to request photo ID of the Ticket holder.

In the event any person attending a show exhibits inappropriate behavior or fails to comply with Hoopla, Inc. rules, Hoopla, Inc. reserves the right to, without any refund or compensation, to terminate such person's license to attend the show.  The Tickets and Gift Certificates purchased on this website are revocable licenses and admission to a Ticket holder may be refused for any reason (or no reason) upon refunding the Ticket's face value.  Tickets and Gift Certificates shall not be redeemable for cash.


Recording, Transmission and Publication

All cameras, tape recorders, and video recorders (including when incorporated in cellular phones) and their use are strictly forbidden on the site of the show. You hereby grant Hoopla, Inc. the right to use your image, likeness, actions and statements in any transmission, publication or reproduction of the show in any means or circumstances, without any further permission or compensation.


No Resale

Any unlawful resale of Tickets and Gift Certificates is strictly prohibited. Hoopla, Inc. reserves the right to cancel the license granted under the Tickets and Gift Certificates sold illegally, without refund or other compensation. The Tickets and Gift Certificates may not be used for any advertising and/or promotional purposes (including contests and sweepstakes) or resold without the prior written authorization from Hoopla, Inc.


Use of Personal Information

In addition to but not limited to the generality of the provisions set out in our Privacy Policy, by purchasing Tickets and Gift Certificates through this website, you agree that the personal information you provide us may be used by Hoopla, Inc. or its affiliates and other persons acting on behalf of Hoopla, Inc., in order to add you to our distribution list to propose you offers and other promotional or marketing activities and to provide you with the latest information about the shows of Hoopla, Inc.  We remind you that if you wish that we discontinue use of your personal information, please Contact Us.


LIMITATION OF LIABILITY

NOTWITHSTANDING ALL SECURITY MEASURES IN PLACE ON THE ARENA/TENT, INJURY MAY OCCUR DURING THE SHOW. BY ACCEPTING THE TERMS OF THIS AGREEMENT, YOU ASSUME ALL RISK, LIABILITY AND RESPONSIBILITY FOR ANY AND ALL DAMAGES OF ANY NATURE SUFFERED BY YOU, INCLUDING, WITHOUT LIMITATION, BODILY HARM AND LOSS OF PROPERTY INCURRED DURING OR IN CONNECTION WITH THE SHOW. FURTHERMORE, YOU HEREBY WAIVE ANY AND ALL RIGHTS TO CLAIM DAMAGES OR TO INSTITUTE CIVIL, CRIMINAL, ADMINISTRATIVE OR LEGAL PROCEEDINGS AGAINST HOOPLA, INC., ITS AFFILIATES AND OTHER RELATED ENTITIES OR THEIR DIRECTORS, OFFICERS, ADMINISTRATORS, EMPLOYEES, REPRESENTATIVES AND ALL OTHER PERSONS ACTING ON BEHALF OF HOOPLA, INC., RESULTING FROM ANY CAUSE WHATSOEVER ARISING EITHER BEFORE, DURING OR AFTER THE SHOW.


IN CERTAIN CASES, APPLICABLE LAWS MAY NOT ALLOW THE LIMITATION OF LIABILITY SET FORTH ABOVE, SO THIS LIMITATION OF LIABILITY MAY NOT APPLY IN SUCH PARTICULAR CASES.  IF ANY PART OF THIS LIMITATION ON LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON, THEN HOOPLA, INC.’S AGGREGATE LIABILITY (AND THAT OF ITS AFFILIATES AND OTHER RELATED ENTITIES OR THEIR DIRECTORS, OFFICERS, ADMINISTRATORS, EMPLOYEES, REPRESENTATIVES AND ALL OTHER PERSONS ACTING ON BEHALF OF HOOPLA, INC. UNDER SUCH CIRCUMSTANCES FOR LIABILITIES THAT OTHERWISE WOULD HAVE BEEN LIMITED SHALL NOT EXCEED ONE THOUSAND PHILIPPINE PESOS (PhP1,000).

 

Indemnification

You hereby agree to indemnify and hold harmless Hoopla, Inc., its affiliates and other related entities, their directors, officers, administrators, managers, employees, representatives and all other persons acting on behalf of Hoopla, Inc. from and against any and all claims, actions, damages or other demands, including, but not limited to, reasonable costs and expenses of litigation such as counsel fees, arising from or relating to your purchase of and your use of this website and any content contained herein.

Applicable Laws

If the tickets and gift certificates purchased through this website are for a show presented in Philippines, the parties hereby agree that this Agreement shall be interpreted and governed by the applicable laws of the Republic of the Philippines, without regard to its conflict of law provisions. Furthermore, the parties hereby elect to submit to the exclusive jurisdiction of the Philippine courtsin respect of any action or proceeding arising out of or related to this Agreement without prejudice however to the rights of Hoopla, Inc. to obtain any protective proceeding such as an injunction from any competent court having jurisdiction.
